TypingDNA Terms of Use

1. Terms

By accessing the website at https://www.typingdna.com or its affiliated services (all TypingDNA applications and services, including TypingDNA Authenticator), you are agreeing to be bound by these terms of service, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in the websites and apps are protected by applicable copyright and trademark law.

TypingDNA Service provides algorithms for identifying and authenticate users based on typing biometrics (also known as keystroke dynamics and typing patterns). It's used as a second-factor authentication and it's not recommended to be used as a single factor authentication. Only with the consent of the user, we learn the user typing patterns and based on user learning, we define and compute a match score (true/false value or in percentage; depending on use case).

TypingDNA does not guarantee perfect correctness, as nonbiometric id system provides. Using different device, keyboard or health condition (drunk, broken arm or any action that is substantially different) can affect the accuracy of TypingDNA matching.

TypingDNA collects, stores and further processes personal data as a result of, or in the course of, providing the TypingDNA Website and/or any of its products and services hereunder. Please review our Privacy Policy, available here https://www.typingdna.com/legal/TypingDNAWebsitePrivacyPolicy.pdf , which regulates how we process personal data. Your continuing use of our Website and/or any TypingDNA service and/or product shall be considered as your agreement to the terms of the Privacy Policy. Users are hereby advised that the Company may update or amend the Privacy Policy from time to time (at which time for substantial changes we will take reasonable effort to notify registered Users through their registered method of communication). Continuing use of our Website and/or any TypingDNA service and/or product (including a Demo version thereof) shall be considered as consent/agreement to such updated terms of the Privacy Policy.

If you use TypingDNA API services, you agree to require similar terms of use, provided by us, for your end users. Explicitly, you have to make sure your users understand and agree that their personal identifiable information may be recorded, stored, and used.

2. Use License

1. 2.1. Permission is granted to temporarily download one copy of the materials (information or software) on TypingDNA's website for personal, non- commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
   1. 2.1.1. modify or copy the materials;
   2. 2.1.2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
   3. 2.1.3. attempt to decompile or reverse engineer any software contained on TypingDNA's websites and applications;
   4. 2.1.4. remove any copyright or other proprietary notations from the materials; or
   5. 2.1.5. transfer the materials to another person or "mirror" the materials on any other server.
2. 2.2 This license shall automatically terminate if you violate any of these restrictions and may be terminated by TypingDNA at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

1. 3.1. The materials on TypingDNA's websites and applications are provided on an 'as is' basis. TypingDNA makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
2. 3.2. Further, TypingDNA does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its websites and application or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall TypingDNA or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on TypingDNA's websites and applications, even if TypingDNA or a TypingDNA authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of materials

The materials appearing on TypingDNA's websites and applications could include technical, typographical, or photographic errors. TypingDNA does not warrant that any of the materials on its websites and applications are accurate, complete or current. TypingDNA may make changes to the materials contained on its websites and applications at any time without notice. However, TypingDNA does not make any commitment to update the materials.

6. Links

TypingDNA has not reviewed all of the sites linked to its websites and applications and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by TypingDNA of the site. Use of any such linked websites and applications is at the user's own risk.

7. Modifications

We may update, revise or amend the Terms of Use and/or any other policies, terms or conditions applicable to the use of the Website and/or our Products and Services, at any time. Continuing use of the Website, or any TypingDNA Products and/or Services signifies your agreement to be bound by the current version of such Terms of Use. While we will take reasonable efforts to notify Users/Customers of substantial changes brought to these documents, Users/Customers are exclusively responsible and liable for keeping up to date of the latest applicable version of these documents.

8. Governing Law

These terms and conditions shall be governed by and interpreted in all aspects in accordance with the laws of New York, US and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
